LIGHT FOUNDATION TURKEY TOUCHDOWN GIVEAWAY OFFICIAL RULES

NO PURCHASE OR CONTRIBUTION NECESSARY TO PARTICIPATE VOID IN ALABAMA, HAWAII, UTAH, AND WHERE OTHERWISE PROHIBITED OR RESTRICTED BY LAW.

 

GENERAL

Light Foundation Turkey Touchdown Giveaway (“Giveaway”) will begin on Wednesday, February 14, 2024, at 12:00:01 a.m. Eastern Time (“ET”) and will end on Friday, March 15^th, 2024 at 4:30:00 p.m. ET (“Giveaway Period”).  Before participating in the Giveaway, each entrant must review and agree to be bound by the Giveaway’s Official Rules as set out below. By entering the Giveaway, entrants accept and agree to be bound by the Official Rules, and accept the decisions of Sponsor as final and binding in all respects.

 

SPONSOR

Giveaway is sponsored by The Light Foundation, and is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Twitter. All communication with respect to the Giveaway, including requests to be removed from future promotions, should be emailed to Sponsor at admin@mattlight72.com with a reference to this Giveaway in the subject line or body of the email.

Eligibility

The Giveaway is void where prohibited or restricted by law. The Giveaway is available and open to all legal United States residents (EXCEPT residents of Alabama, Hawaii and Utah) who are at least the age of majority in their state of residence as of January 1, 2024, and who have a valid email address and phone number. The Giveaway is not open to the following persons: employees, agents or representatives of Sponsor, the subsidiaries and affiliates of Sponsor, or employees, agents or representatives of suppliers providing prizes or other materials or services in connection with the Giveaway, including promotional agencies (collectively, the “Excluded Individuals”); immediate household family members (parent, child, sibling and spouses of each) of the Excluded Individuals; and any other persons with whom the Excluded Individuals reside.

HOW TO ENTER

Entrants automatically entered by making a contribution to Sponsor at TurkeyTouchdown.com (“Website”) during the Giveaway Period (“Automatic Entry”). The number of entries an Entrant receives in the Giveaway through an Automatic Entry is based on the amount of the contribution made to Sponsor as listed below. Multiple Automatic Entries from the same Entrant, as determined in the sole discretion of Sponsor, shall be aggregated to determine the total number of entries received.

To enter the Giveaway without making a donation, send a post card with Entrant’s name, address, email address and phone number to 1 Merchant Street, Suite #4, Sharon, MA 02067 (“Mail-in Entry”).  Mail-in Entries must be received by March 13, 2024, to provide ample time to be processed by the end of the Giveaway Period.  Entrants will receive five (5) entries into the Giveaway for each Mail-in Entry.  Entrants may send multiple Mail-in Entries during the Giveaway Period to receive up to the maximum number of entries allowed during the Giveaway Period.

Maximum 3,000 entries per person during the Giveaway Period whether through Automatic Entry or Mail-in Entry. Multiple entries can be mailed together but EACH ENTRY NEEDS TO BE ON A SEPARATE POSTCARD.  Entrants must provide all information requested at the Website or required by these Rules for a Mail-in Entry in order to participate in the Giveaway.  No contribution or purchase necessary to participate in the Giveaway. Void in Alabama, Hawaii and Utah and where otherwise prohibited by law. All entries become property of Sponsor and will not be acknowledged or returned. Use of automated devices is not valid for entry. Sponsor is not responsible for any computer malfunctions, website tampering or any technical difficulties that may occur.  Sponsor’s computer is the official timekeeper for the Giveaway.

PRIZES

There will be one (1) prize package awarded (each a “Grand Prize”).  The Grand Prize shall include: (i) a trip for two (2) guests to go on a hunting trip to The Gilchrist Club from March 26^th to March 29^th, 2024,  with Matt Light and friends; includes (ii) lodging and meals and for winner and guest; (iii) a travel stipend of $1500 for travel for winner and (defined below) and guest;  (iv) a turkey call package provided by Strut Commander and (v); a one-year membership to Buck Commander which comes with quarterly shipments of curated products, and access to limited-edition gear and giveaways. Travel arrangements to and from the trip are the sole responsibility of the Grand Prize Winner.   Cash prizes are payable by certified check, wire transfer or other method mutually agreed upon by Sponsor and Qualified Winner.

Total approximate retail value of prize: US$7,000.00 per package; Any difference between the estimated value and the actual value will not be awarded. All transportation, meals, and other costs and expenses not otherwise identified herein are the responsibility of the winner. Hotel stay must be completed to coincide with Event. Major credit card will be required at hotel check-in to cover any incidental expenses. Any person taking part in the trip who is a minor under the laws of their jurisdiction of residence must be accompanied by a parent or legal guardian who also must execute all documents on behalf of the minor, including but not limited to Claim Forms. Winner and travel companion must have all ID and other documents necessary for travel. All dates are subject to change.  Sponsor assumes no responsibility for cancellation of Event, or any other events beyond Sponsor’s control, including delays or cancellations; in the event of such cancellation or unavailability, the remainder of the trip will be awarded as the complete prize.  Prize is non-transferable and no cash equivalent or substitution of the prize is offered, except at the sole discretion of the Sponsor. Sponsor may substitute a prize or prize component of comparable value if advertised prize becomes unavailable.

Prize Conditions: Sponsor may conduct a background check to confirm eligibility and compliance with these rules.  By entering, you agree to cooperate reasonably with any such background check.  Failure to cooperate may result in disqualification and selection of an alternate winner.  If a potential winner or potential guest has engaged in or does engage in any conduct that could damage the reputation or business of Sponsor, as determined by Sponsor in its discretion, the potential winner may be disqualified and the prize may be awarded to an alternate winner, time permitting.   Each potential winner and potential guest must also comply with all requirements for proper and appropriate behavior during any prize-related activities or events.   Any inappropriate behavior, as determined by Sponsor in its sole discretion, may result in removal from any activity or event.

TAXES

Winner is responsible for all federal, state and/or local taxes, and for any other fees or costs associated with acceptance or use of any prize. Winners will be issued a Form 1099 and shall be responsible for any tax liability.

ODDS OF WINNING

The overall approximate odds of winning depend on the number of eligible entries received during the Giveaway Period and before the specified drawing deadlines.

PRIZE DRAWING DATES/DEADLINE

One (1) potential winner for the Grand Prize (each a “Potential Winner”) will be randomly selected from all eligible entries received during the Giveaway Period will be held on or about Friday, March 15, 2024. All decisions made by the Sponsor regarding the Giveaway are made in the Sponsor’s sole discretion and are final in all respects.

Sponsor will notify each Potential Winner by email as soon as possible after the drawing. Sponsor may, in its discretion, confirm with a winner by telephone. Only one attempt to contact a potential winner will be made. In the event Sponsor is unable to contact a potential winner, such winner’s prize will be forfeited and an alternate winner may be chosen by Sponsor. The email notification will include a copy of a Release and Eligibility Agreement (“Claim Form”), and other information required to claim the prize. The completed Claim Form must be received by Sponsor within twenty-four (24) hours of attempted notification (“Submission Deadline”). Notification shall be deemed to occur when the email notification is sent from Sponsor’s computer to a potential winner’s email address provided during the entry process. All completed Claim Forms become the property of Sponsor. All Claim Forms will be verified by Sponsor. In order to claim a prize, a potential winner must complete the Claim Form which includes representations of eligibility, compliance and releases of liability, and a publicity release. Among other things, the submission of the Claim Form confirms compliance with these rules, acceptance of the Grand Prize as awarded and release of certain parties from any losses, liabilities, damages or claims arising from or related to the prize awarded and the Giveaway itself. If a Potential Winner fails to submit the Claim Form with all information required by the Submission Deadline, Sponsor reserves the right to disqualify a Potential Winner, and Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. A Potential Winner must prove he or she is the qualified winner by presenting identification acceptable to Sponsor (e.g., state driver’s license; state issued identification card; valid passport with address verification; or birth certificate with social security card and photo identification and address verification).

A POTENTIAL WINNER IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL A POTENTIAL WINNER’S ELIGIBILITY HAS BEEN VERIFIED AND THE POTENTIAL WINNER HAS BEEN NOTIFIED VERIFICATION IS COMPLETE (“Qualified Winner”). If a Potential Winner cannot prove they are a Qualified Winner, the prize will not be awarded. If a Potential Winner declines the prize, another Potential Winner may be selected from the eligible entries received.

CONDITIONS AND RELEASE

By participating in the Giveaway, each Entrant agrees: (a) to abide by these rules and the decisions of Sponsor, which shall be final and binding in all respects; (b) to comply with the terms and conditions of use for Facebook, Instagram or Twitter at all times and in all respects; (c) to release and hold harmless Facebook, Instagram or Twitter, Sponsor, its subsidiaries and affiliates of Sponsor and the franchisees and affiliated merchants of each of the foregoing, all prize suppliers, all agents or representatives of the foregoing, including without limitation their advertising and promotional agencies, and each of their respective officers, directors and employees (collectively, the “Released Parties”) from any and all claims, liability, loss or damage whatsoever arising with respect to the Giveaway or the awarding, receipt, possession and/or use or misuse of any Giveaway prize and further acknowledges that none of the foregoing persons have made nor are responsible or liable for any warranty, representation or guarantee a particular purpose thereof; and (d) to consent to the use of his or her name, image, voice, likeness, city and state of residence and/or photographs without compensation in any publicity or advertising carried out in any medium worldwide by Sponsor and/or its advertising or promotional agencies without limitation or further notification, and without providing compensation or intellectual property rights to the Entrant, except where prohibited. Prizes awarded may carry their own terms and conditions and product warranty, for which the Released Parties have no responsibility of liability.

GENERAL CONDITIONS

By participating, entrants agree to be bound by these official rules and the decision of Sponsor and waive any right to claim ambiguity in the Giveaway or these Official Rules. Entries that are incomplete, mutilated, altered, reproduced, forged, counterfeited or irregular in any way are automatically void. The Released Parties are not responsible for the following: (a) lost, late, delayed, illegible, inaudible, stolen, damaged, altered, destroyed, mutilated, misdirected, illegal, incomplete or postage due rule requests, entries or prize claims; (b) lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software typographical, mechanical, telephonic, electronic or network relating to or in connection with this Giveaway, including, without limitation, errors which may occur in connection with the administration of the Giveaway, the processing of entries, the announcement of the prizes, or in any Giveaway-related materials; or any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the Giveaway.

 Sponsor reserves the right, in its sole discretion, to cancel, suspend, terminate or modify the Giveaway if the Giveaway is not capable of being completed as planned for whatever reason. Sponsor may prohibit or disqualify an entrant from participating in the Giveaway or winning the prize if, at its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, deception or unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. Any person attempting to defraud or in any way tamper with the Giveaway will be ineligible to participate in the Giveaway and may be prosecuted to the full extent of the law. No correspondence will be entered into except with Entrants selected a potential winner.

By entering the Giveaway and voluntarily providing personal information as described in these Official Rules, Entrant agrees agree to the collection and use of Entrant’s personal information by Sponsor and its representatives, promotional agencies and marketing organization for the purpose of administering the Giveaway, including without limitation contacting entrants in the respect of the Giveaway and disclosing the list of winners. Entrants’ personal information may be used for future promotions and solicitations of Sponsor, its affiliates, representatives, and promotional agencies but will not be used for any other purpose nor will it otherwise be disclosed to third parties, unless otherwise required by law.

This Giveaway and the terms and conditions contained in these Official Rules shall be exclusively governed and constructed in accordance with the laws of the State of Ohio and the federal laws of the United States of America applicable therein. Should there be a conflict between the laws of the State of Ohio and any other laws, the conflict will be resolved in favor of the laws of the State of Ohio. Any dispute, claim or controversy arising out of or relating to the Giveaway will be resolved individually, and without resort to class action, exclusively by binding arbitration in Greenville, Ohio, before a single arbitrator. The arbitration shall be administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures. The arbitrator shall be an expert in the field of marketing and promotions. All parties shall bear their own expenses, except that parties shall equally share the expenses of the arbitrator (except for the required non-refundable filing fees which shall be paid solely by the party asserting the related claim). Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. If any one or more provisions of these rules are held to be invalid, illegal or unenforceable by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect the validity, effect or enforcement of any other provision or provisions of these rules.

This Giveaway is subject to all applicable federal, state, local laws and regulations. Void where prohibited or restricted by law.

PUBLICITY/USAGE RIGHTS

To the extent allowed by applicable law, participation in the Giveaway, and/or receipt or use of any prize further constitutes winner’s consent for use of their name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, now known or hereafter developed, worldwide, in perpetuity, without further review, notification, payment, or consideration (unless prohibited by law).

RELEASE OF LIABILITY

To the extent permitted by applicable law, by participating, you release Sponsor and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all others associated with the development and execution of this Giveaway (“Released Parties”) from any and against any and all claims, liability, loss, attorneys’ fees and costs of litigation and settlement, or damage whatsoever arising with respect to the Giveaway or the awarding, receipt, possession or use or misuse of any Giveaway prize.

 ENTRANTS ACKNOWLEDGE THAT THE RELEASED PARTIES HAVE NOT MADE NOR ARE RESPONSIBLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO OR IN CONNECTION WITH THE GIVEAWAY, ANY GIVEAWAY MATERIALS, GUIDANCE OR COMPONENTS THERETO, INCLUDING, WITHOUT LIMITATION, QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

 Prizes awarded may carry their own terms and conditions and product warranty, for which the Released Parties have no responsibility of liability. Released Parties will have no liability whatsoever for failure to supply a prize or any part thereof, by reason of any acts of God, any severe weather, hurricane, flood, fire, war, transportation interruption of any kind, or any other cause beyond their control. By participating, Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Giveaway, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) to the extent permitted by applicable law, any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Giveaway, but in no event attorney’s fees; and (c) unless specifically prohibited by law, under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

JURY TRIAL WAIVER

EXCEPT AS PROHIBITED BY LAW AND AS A CONDITION OF PARTICIPATING IN THIS GIVEAWAY, ENTRANT HEREBY WAIVES ANY RIGHT ENTRANT MAY HAVE TO A TRIAL BY JURY IN RESPECT TO ANY LITIGATION DIRECTLY OR INDIRECTLY ARISING OUT OF, UNDER OR IN CONNECTION WITH THIS GIVEAWAY, ANY DOCUMENT OR AGREEMENT ENTERED INTO CONNECTION HEREWITH AND ANY OF THE TRANSACTIONS CONTEMPLATED HEREBY OR THEREBY.

DATA COLLECTION/PRIVACY

BY CHOOSING TO ENTER THIS GIVEAWAY, EACH ENTRANT ACKNOWLEDGES AND AGREES THAT (i) THE ENTRANT HAS OPTED-IN TO SPONSOR’S PRIVACY POLICY AVAILABLE AT https://lighthousesweepstakes.org/privacy/ AND (ii) BY OPTING-IN, THE ENTRANT HAS READ AND CONSENTS TO SPONSOR’S PRIVACY POLICY AND TERMS OF USE. EACH ENTRANT FURTHER ACKNOWLEDGES THAT IF THEY ARE CHOSEN AS A POTENTIAL WINNER, CERTAIN IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES AT LEAST AS REQUIRED BY LAW INCLUDING, WITHOUT LIMITATION, ON A WINNERS’ LIST.

WINNERS LIST

For the winner’s name, available approximately two weeks after the end of the Giveaway Period, send a written request to the Sponsor, via electronic mail to admin@mattlight72.com with “Light Foundation Turkey Touchdown Winner List” in the subject line. All such requests must be received by July 1, 2024.

SPONSOR

FORCE MAJEURE

Sponsor reserves the right, without prior notice and at any time, to terminate the Giveaway, in whole or in part, or modify or suspend the Giveaway, or any portion thereof, in any way, if it determines, in its sole discretion, that the Giveaway is impaired or corrupted or that fraud, breach of confidentiality, or technical problems, failures or malfunctions have destroyed or severely undermined the integrity and/or feasibility of the Giveaway. In the event Sponsor is prevented from continuing with the Giveaway as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Giveaway.
